· Personal information
RUSHIKA FOOD PRODUCTS PVT. LTD. (RFPPL) is the licensed owner of the brand KemChho Fresh and the website “WWW. KEMCHHOFRESH.COM.” RFPPL respects your privacy. The manner in which all your data is collected and used by RFPPL on the site is briefly provided in the Privacy Policy. The privacy policy must be read carefully by the shopper. By accessing the services, you agree to the collection and use of data in the manner provided in this privacy policy by RFPPL.
· Service overview
KemChho Fresh is an online ecommerce platform for domestic consumers to access and purchase from the platform. As part of the registration process in the beginning, KemChho Fresh may collect the following personal information about the shopper: Name including first name and last name, contact number, mobile phone number, contact details, alternate email address, postal code, demographic information (such as age, gender, occupation, address, education etc.) and information about the links you click on the application and the number of times the page accessed by you and any such browsing details.
Services on the platform is only available on selected geographic locations in Ahmedabad currently and are subject to restrictions based on business hours and days in accordance to KemChho Fresh.
Orders placed online may be subject to delivery charge where the minimum order quantity is not met. Shoppers will be informed of any such delivery charges at the check-out. KemChho Fresh reserves the right to change the delivery charges as per their requirement.
· Eligibility
Persons who are “incompetent to contract” according to Indian Contract Act,872 including minors, undischarged insolvents, etc. are not eligible to use or access the online platform.
However, any minor i.e. under the age of 18 years may access the platform under the supervision of an adult parent or legal guardian who agrees to these Terms of Use. Minors however are prohibited to purchase any product which is for adult consumption and any sale to minors is prohibited and illegal.
KemChho Fresh has sole discretion and without liability rights to terminate and refuse registration to the online platform if
- The shoppers are discovered or brought to notice that they do not conform to the eligibility criteria
- KemChho Fresh has a reason to believe that the eligibility criteria are violated or not met by the shopper
- Shoppers may breach the terms of the User Agreement
KemChho Fresh in order to compliance with eligibility criteria, may use technology from time to time to restrict or block accounts that overlap in the system. In such cases, if there are any genuine shopper facing problem, please contact customer representative for assistance.
· License and site access
KemChho Fresh grants a limited sub-license to the shoppers to access and make personal use of the online platforms and not to download to modify any portion without written consent of KemChho Fresh. The online platform may not be duplicated, reproduced, resold, duplicated or otherwise exploited for any commercial purpose without prior notice to KemChho Fresh. There is no consent on framing or utilizing framing techniques to use trademark, proprietary information or logo of KemChho Fresh without expressing prior written consent to the company. You may not use any meta tags or any other "hidden text" utilizing the Site’s or KemChho Fresh name or trademarks without the express written consent to KemChho Fresh.
· Account and Registration obligations
All the shoppers need to register and login into their account while placing order on the online platform. All the registration details need to be kept current for communication from KemChho Fresh. All the shoppers agree to receive promotional communication and newsletter by agreeing to terms and conditions. The shoppers have an option of unsubscribing in “My Account” or by contacting our customer service representative.
· Cancellation by site/customer
Shoppers can cancel their order anytime up to the cut off time of the slot which is 3 pm from “My order” in the app or website. In any such cases, the refund payments will be processed in shoppers account. If there are any fraudulent transaction by any shopper or if any transaction defies the terms and condition of using the platform, KemChho Fresh has sole discretion of canceling such orders and terminate their registration.
· Returns and refund
We strive to provide you with the highest quality fruits. Please understand that our fruits are naturally grown and delicate, and may be affected by unpredictable weather conditions. As climate change impacts seasons globally, there may be instances where fruits spoil unexpectedly due to internal or external factors. Because of their perishable nature, we cannot offer replacements. Thank you for your understanding.. We cannot offer refunds once an order has been placed. This policy is in place because of the delicate nature of the fruits and the effort involved in harvesting and packaging them.
· Pricing
All the items sold online on the platform are at MRP unless otherwise mentioned. The prices that are specified at the time of ordering will be the prices charged at the date of delivery. Although the prices do not fluctuate on daily basis, but some of the fresh fruits and vegetable are price sensitive and may fluctuate daily. If on any circumstances the prices are higher or lower on the date of delivery no addition charge will be refunded or collected at the time of delivering the order.
· Order Limit and Minimum Order Value
Each shopper has an eligibility of ordering 6 live orders. Live orders mean all the orders that are yet to delivered. A shopper cannot place 7th order if he/she has 6 live orders.
· Modification of Terms & Conditions of Service
KemChho Fresh reserves the right to modify the terms and conditions of use of the online platform without any prior notice to the shoppers. Shoppers can have access to the latest version of the Terms and Conditions at any given point from the platform. Shoppers are advised to review the Terms & Conditions regularly. If any shoppers do not accept the new Terms & Conditions, he/she should discontinue the service. However, in this case of modification if you continue to use the platform it will be deemed that shoppers have agreed and accepted the modified Terms & Conditions of this site.
· Colors
KemChho Fresh does their best effort to display the colors of the product that appear on the platform as accurately as possible. However, the actual colors that the shoppers see on the platform depend on their monitor, KemChho fresh cannot guarantee that the monitor’s display will be accurate.
· Reviews, Feedback, Submissions
All the comments, feedback, reviews, ideas, suggestions and any other submissions offered, disclosed or submitted on the platform or otherwise offered, disclosed or submitted in connection with the use of platform shall remail the property of KemChho Fresh. Such submission, disclosure or offer of any Comments shall establish an obligation to KemChho Fresh of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, KemChho Fresh shall exclusively own all such rights, titles and interests in the Comments and shall not be limited in any way in its use, commercial or otherwise. KemChho Fresh has the right to use, disclose, adapt, reproduce, modify, create derivative work from, publish, distribute and display any comments shopper submit for any purpose whatsoever, without having any restriction and without having to compensate the shopper in any way. KemChho Fresh has no obligation
- To pay you any compensation for any comments
- To respond to any comments
- To main any comments in confidence.
Shoppers in turn agree that all the comments submitted to the platform will not violate the rights of this policy or any third party, including copyright, privacy, trademark or other personal or proprietary rights and will not cause injury to any entity or to any person. Shoppers also further agree that no comments submitted by him/her will be or containing libelous or threatening, unlawful, abusive or offensive material or contain any software virus, political campaigning, chain letters, mass mailing, any form of “spam” or commercial solicitation.
KemChho Fresh does not regularly review the comments posted by the shopper but does reserve the right (but not the obligation) to edit, remove or monitor any comments submitted to the platform. The shoppers grant the rights to KemChho Fresh the right to use the name of the shopper that he/ she submit in connection with any comments. Shoppers agree to not imitate any person or entity or submit false email address in origin to any comments. Shoppers are solely responsible for his/ her comment and agree to assure KemChho Fresh and associates for all the claims resulting from the comments. KemChho Fresh and its partners assume no liability and takes no responsibility for any comments submitted by the shopper.
